Terms and conditions
This text is a machine translation of the German version. In case of discrepancies, only the German version is binding. German version
1. Scope and contracting party
These terms and conditions govern the booking and use of the holiday accommodation designated in the listing and the associated rights and obligations between you as the guest and the host named in the listing, in the booking process, in the booking confirmation and in the legal notice.
The contracting party for the booking and the stay is exclusively the host. Clavanza provides the host with the technical platform for presenting the accommodation, handling booking enquiries, concluding the contract and processing payments. Clavanza does not act in its own name when the accommodation contract is concluded and does not become a party to the contract. Claims relating to the accommodation, its availability or condition, the stay, the cancellation or a refund are therefore, as a rule, directed against the host.
Deviating agreements apply only if they have been expressly made in text form between you and the host. Individual agreements take precedence over these terms and conditions.
2. Booking enquiry, direct booking and conclusion of contract
The presentation of the accommodation on the website does not, as a rule, constitute a binding contractual offer, but invites you to submit a booking enquiry or a booking offer.
You select the desired travel dates, the number of guests and, where applicable, further booking options. Before the booking is submitted, you are shown in particular the host, the selected accommodation, the travel dates, the number of guests, the total price, the applicable cancellation terms and the essential booking details. You can correct input errors before submitting.
By clicking the “Book and pay” button or a correspondingly unambiguous button, you submit a binding offer to conclude the accommodation contract.
In the case of a direct booking, the contract is concluded upon successful payment authorisation and the electronic booking confirmation. In the case of a booking enquiry, the contract is only concluded once the host has confirmed the enquiry and the required payment has been successfully authorised or executed.
After the contract has been concluded, you will immediately receive an electronic booking confirmation. You are obliged to check the booking confirmation upon receipt and to notify the host immediately of any recognisable errors.
3. Information provided when booking
You are obliged to provide complete and truthful information when booking. This applies in particular to your name, your contact details, the number and identity of accompanying persons, the travel dates and accompanying pets, where these must be declared.
The booking may only be made by a person of legal age with legal capacity. The person making the booking is responsible for the fulfilment of the contractual obligations by all accompanying persons, to the extent permitted by law.
Transfer of the booking to another person is permitted only with the prior consent of the host.
4. Services of the host
The scope of the services owed results from the listing published at the time of booking, the booking summary, the booking confirmation and any individual agreements.
Information on the amenities, location, size, occupancy, availability and other characteristics of the accommodation is prepared with due care. Minor deviations that do not materially impair the contractual use of the accommodation do not give rise to any claims.
Additional services are owed only if they are expressly listed in the listing, in the booking process or in the booking confirmation.
5. Prices, charges and payment
The total price shown in the booking process before the paid booking is submitted applies. It comprises the accommodation price and all mandatory surcharges, in particular any cleaning fee and other non-optional costs. All prices shown to guests are final prices and include any statutory value added tax that may be due.
A visitor's tax or comparable public charge may be shown in addition, provided it is levied separately in accordance with the regulations applicable at the location of the accommodation and remitted to the competent body.
Payment is processed via the payment service provider designated in the booking process. Before the payment is completed, you are shown which means of payment are available. The host may make confirmation of the booking conditional on the total price or an agreed deposit having been successfully authorised or paid.
If, at the time of payment, arrival is more than 80 days in the future, only the deposit shown in the booking process is payable at booking. The balance is due 80 days before arrival. If you pay the deposit by card, you authorise the host to charge the balance to that card on that day. With any other means of payment, or if the charge fails, you will receive a payment link. If the balance is not received within 7 days of this request, the host may cancel the booking; it then counts as a cancellation by you on that day, and the cancellation terms under section 6 apply.
If a payment fails or is declined by the payment service provider, no booking is concluded unless you are expressly confirmed otherwise.
Any refunds are, as a rule, made to the means of payment originally used. The host and Clavanza have no influence on additional processing times of the payment service provider or your bank.
6. Cancellation by you
You cancel via the link contained in the booking confirmation or via the function provided in the booking system. If you no longer have access to the booking confirmation, you can have a new access link sent to you using the e-mail address used when booking, or contact the host. Decisive for the calculation of the cancellation fee is the time at which the cancellation is received in the booking system. The cancellation terms applicable at the time the contract is concluded are recorded in the booking confirmation and remain decisive for the booking concerned. The following cancellation fees apply, calculated on the agreed accommodation price: • from 60 days before arrival: free of charge • 59 to 30 days before arrival: 50% • 29 to 14 days before arrival: 80% • less than 14 days before arrival or in the event of no-show: 100% The cleaning fee is not charged if the accommodation is not used as a result of the cancellation, and is refunded to you in full. The same applies to other costs that demonstrably do not arise as a result of the no-show. If the cancelled period is re-let in whole or in part, the accommodation price actually received from the replacement booking for the overlapping nights is credited in full against the originally agreed accommodation price. Cleaning fees, visitor's taxes and other non-comparable price components are disregarded. Commissions, payment fees and fees of other booking channels are not deducted from the accommodation price to be credited. What remains owed is the resulting uncovered difference to the originally agreed accommodation price, plus proven and reasonable processing costs of no more than CHF 50.00; however, the total amount you owe may in no case exceed the cancellation fee that would be owed under the scale above without re-letting. The host makes good-faith efforts to re-let the accommodation. At your request, the host will disclose the calculation of the remaining cancellation fee to you in a comprehensible form. Refunds are, as a rule, initiated within 14 days after the refund amount has been determined. Taking out travel cancellation insurance is recommended.
7. Changes and cancellation by the host
If the host is unable to provide the booked accommodation for a reason for which the host is responsible, the host will inform you immediately.
Where possible and reasonable for you, replacement accommodation of at least equivalent standard may be offered to you. You are not obliged to accept such an offer.
If no suitable alternative is agreed, payments already made for services not provided will be refunded. Further claims are governed by statutory provisions.
If the accommodation cannot be provided, or can only be provided to a limited extent, due to force majeure, official measures, natural events, significant technical disruptions or other circumstances beyond the host's control despite reasonable care, the parties will seek an appropriate solution. Mandatory statutory claims remain reserved.
8. Arrival, departure and keys
Arrival and departure times result from the listing, the booking confirmation or the information sent to you before arrival. Individual deviations require the prior consent of the host.
Information on arrival, access and key handover will be sent to you in good time before the start of the stay to the e-mail address provided when booking.
You may not pass on keys, access codes and other means of access to unauthorised third parties. You must report any loss or misuse to the host immediately. You are liable for the reasonable and proven costs of replacement or necessary security measures, to the extent that you are responsible for the loss or misuse.
9. Use of the accommodation and guest obligations
You may use the accommodation exclusively for the agreed purpose and with no more than the number of persons stated when booking. Subletting, re-letting or any other transfer to unregistered third parties is not permitted without the prior consent of the host.
You are obliged to treat the accommodation, the inventory and shared facilities with care. The published house rules and the instructions provided to you must be complied with, insofar as they are reasonable and have become part of the contract.
Disturbances, excessive noise, unlawful acts and nuisance to other residents of the building or neighbours must be refrained from.
You must report damage, defects or unusual incidents to the host immediately. You may not refuse necessary and reasonable measures to mitigate damage without good reason.
The host or persons engaged by the host may enter the accommodation during the stay if this is necessary to avert a danger, remedy an urgent defect, perform an agreed service or for another objectively justified reason. Where possible, access will be announced in advance and coordinated with you.
10. Pets
Pets are permitted only if this is provided for in the listing or the host has given prior consent. Accompanying pets must be fully declared when booking.
You are responsible for ensuring that your animal does not cause unreasonable disturbance, soiling or damage. Pets are not allowed on sofas or beds unless the host permits otherwise.
Additional cleaning or repair costs caused by an animal may be charged to you, insofar as they are necessary, reasonable and proven.
11. Defects and complaints
If you notice a defect on arrival or during the stay, you must notify the host immediately and give the host a reasonable opportunity to remedy it.
If you fail to give timely notice although notification would have been reasonable, claims may lapse or be reduced to the extent that the host could have remedied the defect or mitigated the damage had notice been given in time.
Expenses incurred on your own initiative are reimbursed only if they were agreed in advance with the host or were necessary to avert an imminent significant loss.
Mandatory statutory warranty and price reduction rights remain reserved.
12. Damage and liability of the guest
You are liable in accordance with statutory provisions for damage that you or accompanying persons culpably cause to the accommodation, the inventory or shared facilities.
Normal wear and tear and defects already existing on arrival are not your responsibility.
The host is obliged to document claimed damage and the resulting costs in a comprehensible manner. You will be given the opportunity to comment on the damage report.
13. Liability of the host
The host is liable for damage arising from the breach of its contractual or statutory obligations in accordance with the applicable statutory provisions.
For valuables, cash, documents or personal items brought along, the host is liable only insofar as the host or an auxiliary person engaged by the host is at fault or mandatory statutory liability exists.
To the extent permitted by law, liability for slight negligence and for indirect and consequential damage is excluded. Liability for intent, gross negligence, personal injury and other mandatorily prescribed grounds of liability remains unaffected.
14. Role and liability of Clavanza
Clavanza provides the technical infrastructure for listings, booking processes, communication and payment integration. Clavanza owes neither the provision nor the condition of the accommodation and assumes no obligations of the host under the accommodation contract.
Clavanza is not liable for the performance of the accommodation contract by the host or for acts and omissions of guests. For breaches of its own obligations, Clavanza is liable in accordance with statutory provisions.
To the extent permitted by law, Clavanza's liability for slight negligence and for indirect and consequential damage is excluded. Liability for intent, gross negligence, personal injury and other mandatorily prescribed grounds of liability remains unaffected.
15. Reviews
After the stay, you may review the accommodation and your stay. Reviews are permitted only after a stay that actually took place and was paid for.
You are obliged to write reviews that are objective, truthful and related to the stay in question. In particular, unlawful, abusive, discriminatory, threatening, manifestly untrue, promotional or irrelevant content and statements that infringe the rights of third parties are not permitted.
A review may be checked and rejected or removed if there are concrete indications of a breach of these requirements. The mere fact that a review is critical or unfavourable to the host is not a ground for its rejection.
The host may in turn submit a review of the guest. Where the system provides for simultaneous publication, the reviews become visible after both reviews have been submitted, but at the latest upon expiry of the designated review period.
The data protection details are set out in the privacy policy.
16. Communication
Contract-related notices may be sent to the e-mail address you provided when booking. You are responsible for ensuring that this address is correct and that you can receive contract-related messages.
You must notify the host immediately of any changes to your contact details.
17. Applicable law and place of jurisdiction
Swiss law applies, unless mandatory foreign law is applicable.
For consumers, the statutory places of jurisdiction apply. A choice of law or jurisdiction agreement does not restrict mandatory rights to which you are entitled by reason of your domicile or habitual residence.
18. Language versions
These terms and conditions may be displayed in several languages. To the extent legally permissible, the German version prevails in the event of inconsistencies.
Mandatory provisions at the guest's domicile or habitual residence remain reserved.
19. Severability
Should any provision of these terms and conditions be wholly or partly invalid or unenforceable, the remaining provisions remain unaffected.
The invalid or unenforceable provision is replaced by the applicable statutory provisions.
